Code Warriors Warwick Ltd – Terms and Conditions

 

Legal Notice:
Code Warriors Warwick Ltd is a privately operated extracurricular club, legally independent of Myton School. By enrolling a child in any Club activity, the Parent/Guardian agrees to these Terms and Conditions, which are legally binding under the laws of England and Wales.

1. Enrolment

  • Trial sessions are subject to availability and do not guarantee placement.

  • The Club may amend session times, staff, or venue as required without notice or refund.

2. Payment

  • Full payment is required before each term begins.

  • All fees are non-refundable, including in cases of absence, illness, withdrawal, or exclusion.

3. Sessions

  • The Club may deliver sessions online or adjust the delivery format at its discretion.

  • No refunds will be issued for such changes.

4. Conduct

  • The Club reserves the right to exclude any child whose behaviour poses a risk to safety or disrupts the learning environment.

  • Inappropriate, aggressive, or abusive communication by a Parent/Guardian will result in immediate termination of enrolment without refund.

5. Access and Safeguarding

  • Only authorised individuals may be present on site during sessions.

  • Parents, carers, and external individuals are not permitted to attend or assist unless explicitly authorised by the Director.

  • The Club only permits staff or volunteers who are internally approved and DBS-cleared.

  • The Club is under no obligation to process or accept third-party DBS checks or external assistants.

6. Equality and Adjustments

  • The Club complies with the Equality Act 2010.

  • Reasonable adjustments will be considered only where safe, lawful, and practical.

  • Adjustments that compromise safety, safeguarding, or fall outside the Club’s operational scope may be lawfully declined.

  • We maintain internal policies to support fair and inclusive access. These are used for operational guidance and are not shared externally.

7. Liability

  • The Club accepts no responsibility for the loss or damage of personal property.

  • Liability is strictly limited to the amount paid for the current term.

  • The Club shall not be liable for indirect, incidental, or consequential losses or expenses.

8. Media

  • With written consent, the Club may use participant images for marketing or promotional purposes.

  • Consent may be withdrawn at any time in writing.

9. Termination

  • The Club reserves the right to terminate a child’s place at any time for non-payment, breach of terms, misconduct, or safeguarding concerns.

  • Parents may withdraw a child only where the Club repeatedly fails to deliver services to a reasonable standard.

10. Amendments

  • Terms may be updated at any time.

  • Continued participation after updates implies acceptance of the revised terms.

11. Legal Jurisdiction

  • These Terms are governed by the laws of England and Wales.

  • All disputes shall be resolved exclusively in the English courts.

12. Severability

  • If any provision of this agreement is found to be unlawful, void, or unenforceable, that provision will be severed without affecting the remaining terms.

  • This applies even if either party placed material reliance on the affected provision.

13. Communications and Correspondence

  • All communication with the Club must be respectful, relevant, and appropriate.

  • Persistent, hostile, excessive, or vexatious contact — including repeated emails, unfounded complaints, or unreasonable tone — may be deemed harassment.

  • The Club reserves the right to:

    • Cease correspondence

    • Restrict further contact

    • Involve legal or safeguarding authorities where appropriate

  • The Club is not obliged to respond to repetitive, speculative, or legally inappropriate communication.

  • Requests under the UK GDPR will be processed only if personal data is held, and operational documents (e.g. risk assessments, policies) are not classed as personal data.

14. Data Protection

  • The Club operates in accordance with the UK GDPR and the Data Protection Act 2018.
